SECTION 1 - CLUB EVENTS

Ticket Cancellations / No Show Event Fees

Tickets must always be paid for in advance through the club’s event ticketing portal, linked into each event invitation. We reserve the right to retain the ticket value for the full ticket price applied per ticket reserved if guests do not cancel by emailing events@clubvivanova.com before the announced cancellation date (at the booking link) or send someone in their place to fulfil the booking that has been made. Tickets for all events are transferable to other (name change) guests. Re-imbursements for cancelled or voided tickets or any other membership / partnership payments made to Club Vivanova that are required to be returned are charged with a 10% deduction fee as there are double credit card fees and processing charged on such transactions and the club will not pay for or be responsible for these charges. In case of event cancellation by Club Vivanova, tickets will be refunded in full.

Right to Deny Event Entry
Club Vivanova reserves the right to deny event entry to any person whose character might adversely affect the club or our events, the attendees or the reputation of the club, whether or not for cause (ticket fees will be refunded accordingly) and also refers to dress code, which is always stated in advance (in this case tickets cannot be refunded if the guest fails to comply with a dress code at the event registration).

Complimentary Member Events
Guest-lists for our complimentary member events are managed by the event partners who invest into the set-up of the events. We endeavour to please everyone who RSVPs with an invitation, however the final guest list is always filtered by the sponsoring event partner with a view to capacity and client focus. We reserve the right to limit and filter ticketing if required and free membership ticketing rights are non-transferable to third-parties.

Event Filming & Photography
By booking your ticket, all attendees agree to our terms and conditions and consent to photography, filming and sound recording as members of the audience. By booking your ticket and entering the event, you agree to being filmed or photographed, which may be used for marketing or promotional purposes.

Business Introduction Waiver
Club Vivanova and/or Mitton International Wines GmbH do not hold any financial services licence or financial advisers licence or capital markets services licence and do not offer investment advice or any other financial services to any person. Club Vivanova and/or Mitton International Wines GmbH do not sell, or offer to sell, any securities. Any information provided by Club Vivanova and/or Mitton International Wines GmbH during any event is not intended to be advice in relation to an investment in securities. Any investor / partner intending to pursue investments / partnerships with entities introduced to them through Club Vivanova and/or Mitton International Wines GmbH does so at their own risk and is solely responsible for obtaining (and should obtain) their own independent legal, financial, accounting and other professional advice.

Commissions / Referral Fees
Club Vivanova is a virtual club that organises gourmet wine experiences across Europe and in the UK and is a platform that does not profit financially through commissions or referral fees from business connections that are made in conjunction with our event experiences.

Dogs
Dogs are prohibited at all Club Vivanova events. This decision is made ethically for 1. the protection of and in respect to our attendees, 2. for hygienic reasons as our events are mostly food-oriented and 3. for the animal’s welfare, should there be any issues with other attendees or location employees.

Fashion Shows and Musical Entertainment
Club Vivanova is not a fashion brand / music brand and does not directly host fashion shows or musical entertainment, these are both managed as external services, but included into the event itinerary and the ticketing price.

SECTION 2 - CLUB MEMBERSHIP

Automated Membership Renewal
Upon joining Club Vivanova, your credit card will be charged €150 for individual membership, €450 for corporate partnership and €950 for platinum partnership. As long as your membership is current, the same card will be automatically charged with three days email notice every 365 days after the date of joining as per the agreement when joining the club; "Club Vivanova membership runs for one year from the date of joining and is automatically renewed by payment through your registered credit card unless written notice is received". You may cancel your membership plan at any time by emailing our administration at membership@clubvivanova.com. Once your membership is renewed and the annual dues paid, we cannot refund any part of the payment as your wine box will have been dispatched.

Complimentary Member Events

Member & Partner Wine Delivery
As soon as your membership / partnership is processed or renewed, your wine case is dispatched by our preferred courier (DHL or UPS). A tracker will be forwarded. After two attempts at delivery, the wine case will be processed to a pick-up point. If the wine case is not successfully delivered or picked up, the bottles are either returned to us or destroyed by a local customs agency. We do not resend wines. Please keep us posted on any address changes that you might have to make sure we have a successful delivery service in place.

Right to Refuse and Terminate Partnerships / Membership
After membership / partnership payment has been processed, we approve within 24 hours. We reserve the right to refuse memberships / partnerships and refund within that period. We also reserve the right to terminate memberships / partnerships at any time during the course of the 365 day term, without repayment of the membership / partnership fee whether or not for cause.

SECTION 3 - WHAT DO WE DO WITH YOUR INFORMATION? 
When you purchase something from our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer's internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Email marketing (if applicable): With your permission, we may send you emails about our store, new products and other updates. 

In compliance with the EU General Data Protection Regulation enforced on 25th May 2018, Club Vivanova agrees not to share your personal information and we will keep your personal information secure. 

SECTION 4 - CONSENT
How do you get my consent? 
When you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no. 

How do I withdraw my consent? 
You may at any time withdraw your consent for us to contact you, for the continued collection, use or disclosure of your information by contacting us by email at contact@clubvivanova.com. You may also unsubscribe from our mailing services by following the "unsubscribe" link located at the bottom of each of our email invitation communications.

SECTION 5 - DISCLOSURE
We may disclose your personal information if we are required by law to do so or if you violate our Terms of Service. 

SECTION 6 - PAYMENT PLATFORMS (Tickets and Membership)
Our event ticket sales and membership renewals are hosted on Stripe and Moonclerk through Mitton International Wines GmbH in Berlin. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through the Stripe and Moonclerk secure data storage systems, databases and the general Stripe and Moonclerk applications. They store your data on a secure server behind a firewall. 

Event Ticket Payment (Stripe)
If you choose a direct payment gateway to complete your purchase, then Stripe stores your credit card data on our payment system through Mitton International Wines GmbH in Berlin. Credit card data is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. 

Membership Fee Payment, Renewal and Membership Cancellation (Moonclerk)
If you choose a direct payment gateway to complete your membership application, then Moonclerk stores your credit card data on our payment system through Mitton International Wines GmbH in Berlin. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored as long as your membership is current and automatically charged without notice every 365 days after the date of joining. As per the agreement when joining the club, "Club Vivanova membership runs for one year from the date of joining and is automatically renewed by payment through your registered credit card unless written notice is received". You may cancel your membership plan at any time by emailing our administration at membership@clubvivanova.com. After cancellation, your purchase transaction information is deleted. 

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

SECTION 7 - THIRD-PARTY SERVICES
In general, the third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. So if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. As an example, if you are located in Canada and your transaction is processed by a payment gateway located in the United States, then your personal information used in completing that transaction may be subject to disclosure under United States legislation, including the Patriot Act. Once you leave our store's website or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our website's Terms of Service.

When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. 

SECTION 8 - SECURITY
To protect your personal information, we take reasonable precautions and follow industry best practices to make sure it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards. 

SECTION 9 - COOKIES
We use cookies and similar technologies to run this website and help us understand how you use it so we can make the site more user-friendly.

SECTION 10 - AGE OF CONSENT
By using this site, you represent that you are at least the age of majority and consent in your country of residence, and you have given us your consent to allow any of your minor dependents to use this site. 

SECTION 11 - CHANGES TO THIS PRIVACY POLICY
We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it. If our store is acquired or merged with another company, your information may be transferred to the new owners so that we may continue to sell products to you.
